AIRCRAFT PRICING AND TAX IMPLICATIONS

Updated over a year ago

As a seller on our platform, it's crucial to clearly state the total amount you wish to receive for your aircraft and accurately describe the tax implications when you are creating a listing. This helps buyers understand the full cost and tax responsibilities associated with the purchase. Here are the guidelines for indicating tax implications in your listing, with three options:

1. VAT/Sales Tax Included

2. VAT/Sales Tax Not Applicable

3. VAT/Sales Tax Paid

The indicated taxation status conveys specific implications for buyers from different jurisdictions:

VAT / Sales Tax included

1. Buyers in the Seller's Jurisdiction (Same Country):

- Meaning: The seller has included any applicable Value Added Tax (VAT) or sales tax in the listed price.

- Implication: Buyers within the same country as the seller will not have to pay additional VAT or sales tax beyond the listed price. The total cost of the aircraft as seen includes all necessary taxes.

2. Interstate Domestic Buyers (Different State within the Same Country):

- Meaning: The included tax is based on the seller's state regulations and might not align with the tax rates or rules of the buyer's state.

- Implication: Buyers from different states should determine if additional taxes (like use tax) apply when bringing the aircraft into their state. The tax included by the seller may not cover the buyer's state tax obligations.

3. International Buyers (Outside the Seller’s Country):

- Meaning: The inclusion of VAT or sales tax pertains to the seller's domestic jurisdiction and does not cover international taxes or duties.

- Implication: International buyers may be responsible for additional taxes such as import duties or VAT in their country. The "VAT/Sales tax included" term is relevant only to the tax system of the seller’s country.

4. Buyers in Special Tax Categories (e.g., Tax-Exempt Organizations):

- Meaning: The price includes VAT or sales tax as per the seller's obligations.

- Implication: Tax-exempt buyers may wish to discuss with the seller or consult a tax advisor about the possibility of a price adjustment, given their tax-exempt status.

For all buyers, "VAT/Sales tax included" means the listed price accounts for the VAT or sales tax as per the seller’s jurisdiction. However, this does not necessarily address any additional taxes or duties that might apply in the buyer’s location, especially in international transactions.

VAT/Sales tax not applicable

1. Buyers in the Seller's Jurisdiction (Same Country):

- Meaning: The seller is indicating that neither Value Added Tax (VAT) nor sales tax applies to this transaction in their country. This could be due to the seller's tax status, the nature of the sale, or specific exemptions in local tax laws.

- Implication: Buyers from the same country as the seller should not expect to pay additional VAT or sales tax on top of the listed price. However, they should confirm the reason for the tax exemption, as it could impact their ability to claim tax credits or deductions.

2. Interstate Domestic Buyers (Different State within the Same Country):

- Meaning: While the seller’s state or jurisdiction does not require VAT or sales tax on this transaction, it may not reflect the tax laws in the buyer's state.

- Implication: Buyers from a different state may still be subject to their state's sales or use tax regulations. They should verify if additional taxes are applicable when bringing the aircraft into their state.

3. International Buyers (Outside the Seller’s Country):

- Meaning: "VAT/Sales tax not applicable" pertains to the seller's jurisdiction and has no bearing on the tax laws in the buyer's country.

- Implication: International buyers may be responsible for import duties, VAT, or other taxes as per their own country's regulations. The statement only indicates that the seller is not charging these taxes as part of the sale.

4. Buyers in Special Tax Categories (e.g., Tax-Exempt Organizations):

- Meaning: For buyers who are typically exempt from certain taxes, this statement confirms that the seller is not adding VAT or sales tax to the price.

- Implication: These buyers may not have any additional tax obligations related to the purchase, but they should confirm this based on their specific tax-exempt status.

VAT/Sales tax paid

1. Buyers in the Seller's Jurisdiction (Same Country):

- Meaning: The seller indicates that Value Added Tax (VAT) or sales tax applicable in their country has already been paid. This suggests that the aircraft is currently compliant with local tax regulations.

- Implication for Buyers: They will not need to pay additional VAT or sales tax on top of the purchase price for the transaction within the same jurisdiction. The total cost includes these taxes.

2. Interstate Domestic Buyers (Different State within the Same Country, especially in the U.S.):

- Meaning: While sales tax has been paid in the seller's state, it may not align with tax requirements in the buyer's state.

- Implication for Buyers: They may need to pay use tax in their own state, particularly in the U.S., where sales and use tax vary by state. The "Sales tax paid" statement is specific to the seller's location.

3. International Buyers (Outside the Seller’s Country):

- Meaning: The statement refers to the VAT/sales tax status in the seller’s country, which may not be relevant to the buyer's tax obligations.

- Implication for Buyers: International buyers might face import duties, VAT, or other taxes in their own country. The "VAT/Sales tax paid" term applies only to the seller’s jurisdiction and does not exempt the buyer from taxes in their country.

4. EU Buyers (If the Seller is in the EU):

- Meaning: VAT has been handled as per the seller's local requirements in the EU.

- Implication for Buyers: EU buyers need to check if any additional VAT or taxes apply, especially if importing the aircraft from outside the EU or if different VAT rules apply in their country.

5. Tax-Exempt Organizations or Entities:

- Meaning: The price reflects the tax status as per the seller’s obligations.

- Implication for Buyers: Tax-exempt buyers may not benefit directly from the "VAT/Sales tax paid" status but it simplifies the transaction as they won't need to address these taxes.

Both sellers and buyers should approach aircraft transactions with a thorough understanding of the tax implications. Sellers must provide clear, accurate information regarding taxes in their listings, while buyers should be proactive in understanding the potential additional costs. Given the complexities of tax laws, especially in cross-border transactions, professional advice is strongly recommended.
